Term Limits for the Directors of the Marina Hills Board

Between January 6 and January 13, 2004, more than 5% of the Marina Hills homeowners signed a petition to ask the Board of Directors to call a Special Meeting of the Members to vote on term limits for the Directors on the Board.

The proposed change limits any one homeowner to two consecutive terms and three life-time terms as a Director on the Board. Each full term is two years.

Below you find the following information:

  • Reprint of the article from the recent newsletter article about term limits.

Please note, that since the printing of the December 2003 newsletter, SaveMarinaHills.org has learned (but not yet confirmed) that, in the summer of 1997, the sitting Director Jane Dry may have been appointed by the other Directors of the Board and not elected by the homeowners.
  • Proposed amendment to the Bylaws/CC&Rs. You may want to reference the existing Article IV of the Bylaws to see how these proposed changes integrate with the existing's Bylaws.

Hans Strupat, on behalf of the petitioning homeowners, publicly presented this petition with all required signatures to the Board of Directors during the January 13, 2004, Board meeting.

The Bylaws allow the Board a maximum of 20 calendar days to call the Special Meeting. Thus, the Directors have the duty to call this Special Meeting by February 2, 2004.

The Directors have not called a Special Meeting for the homeowners to vote on the Term Limit petition. A follow up-letter was sent to the Board's attorney on February 3, 2004.
